VIDEO: A POWERFUL TOOL FOR THE LITIGATOR
Video can be useful to the litigator for several reasons:
Video is an excellent way to impeach a witness. There is nothing like having a jury watch footage of a witness giving contradictory testimony. When using video deposition testimony synchronized with the transcript by LVTS (making it word-searchable), impeachment testimony can be accessed quickly on-the-fly during the trial using software like Trial Director, Sanction II or Visionary and presented in seconds.
Video simplifies complex issues. Unclear ideas and concepts can be broken down and illustrated to your target audience (juries, judges, insurance company executives, arbitrators, etc.)
Video shows body language. Sometimes body language can be almost as important as the words themselves. The video illustrates the subtlety of a witness’s gestures, tone of voice, posture, facial expressions and other non-verbal cues to the jury, and gives them an impression of his state of mind. Watching the deposition video makes for a more powerful and engaging experience than hearing testimony read from a transcript by an attorney.
Video takes juries to people and places they otherwise would not be able to visit. Video brings the jury to the bedside of an ill patient, or to a construction site before a structure has been built.
Today’s jurors are very comfortable with videotaped evidence. They grew up watching TV; many of them watch hours of television every day and watching a deponent on video is familiar to them. Video is an excellent way to hold the juries attention and enables them to identify with your client.
